ElectIndex (electindex.com) (“ElectIndex,” “the Site,” “we,” “us,” or “our”) publishes election forecasts, models, and analysis. These Terms of Service (“Terms”) govern your access to and use of the Site, including articles, forecasts, dashboards, maps, data visualizations, comments, accounts, subscriptions, donations, newsletters, and any other services that link to these Terms.
By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
01Eligibility and Accounts
You must be able to form a legally binding agreement to use account, subscription, donation, comment, or interactive features. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information, keep it current, and notify us promptly of unauthorized access or suspected compromise.
02Purpose of the Site; No Professional Advice
The Site provides political journalism, commentary, election analysis, forecasting, data visualization, mapping, and educational tools. Content is for informational and editorial purposes only. Nothing on the Site is legal, financial, investment, tax, professional, campaign, lobbying, or voting advice. You are responsible for your own decisions and should verify important information independently.
03Forecasts, Data, and Accuracy Disclaimer
Forecasts, models, maps, swingometers, election data, polling references, demographic data, and other datasets are based on sources, assumptions, transformations, and judgment calls that may be incomplete, delayed, incorrect, or subject to change. We may rely on third-party data sources and public repositories that we do not control.
We do not guarantee the accuracy, completeness, timeliness, availability, methodology, or fitness for any purpose of any forecast, model, probability, rating, map, data point, article, or visualization. Past performance does not guarantee future results. Do not rely on the Site as the sole basis for legal, financial, professional, voting, campaign, business, or safety decisions. See our Disclaimer.
04Subscriptions, Donations, and Payments
Some features may require payment, membership, donation, or subscription. Prices, features, billing periods, and benefits may change prospectively. Taxes, transaction fees, and currency conversion fees may apply.
Payments are processed by third-party processors, including Stripe. By submitting payment information, you authorize the applicable charge and agree to the processor’s terms. We do not intentionally store full payment-card numbers on our own systems.
Paid subscriptions renew automatically until canceled. Cancellations and refunds are governed by the Refunds and Cancellations section below.
05Refunds and Cancellations
Canceling. You can cancel a paid subscription at any time from your account or by contacting us. When you cancel, the subscription stops renewing and your paid access continues through the end of the billing period you have already paid for. We do not automatically prorate or refund the unused portion of a billing period.
Refunds. If you were charged in error, charged more than once, or were billed for a renewal you did not intend, contact us within 14 days of the charge — at [email protected] or through our contact page — and we will refund that payment. After 14 days, refunds are provided at our discretion and are not guaranteed.
Annual plans. For an annual subscription canceled after the first 14 days, access continues until the end of the paid year; the remaining months are not refunded unless required by law.
Donations. Donations are voluntary and non-refundable once processed, except in the case of a clear processing error or where a refund is required by law.
Before a chargeback. Please reach out before disputing a charge with your bank — we can almost always resolve a billing issue directly, and usually faster.
This policy does not limit any statutory cancellation or refund rights you have in your jurisdiction that cannot be waived.
06Acceptable Use
You agree not to:
- violate laws, regulations, court orders, or third-party rights;
- post or transmit false, defamatory, harassing, threatening, hateful, obscene, exploitative, or unlawful material;
- impersonate others or misrepresent affiliation;
- interfere with elections, voting rights, civic participation, or public safety;
- attempt to access accounts, systems, data, or areas you are not authorized to access;
- probe, scan, attack, overload, disrupt, reverse engineer, or compromise the Site;
- upload malware, tracking code, spam, or malicious content;
- scrape, crawl, harvest, mirror, or mass-download content except as permitted by robots.txt, written permission, or ordinary search indexing;
- use automated tools to create accounts, submit comments, bypass rate limits, manipulate metrics, or evade moderation;
- remove attribution, copyright notices, or security features;
- use the Site or our content to train models, build competing datasets, or create commercial products without permission where permission is required.
07User Content
You are responsible for comments, submissions, profile information, messages, uploads, and other content you provide (“User Content”). You represent that you own or have the rights needed to submit it and that it does not violate law or third-party rights.
By submitting User Content, you grant ElectIndex a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, publish, excerpt, moderate, remove, and distribute that content in connection with operating, promoting, archiving, and improving the Site. This license continues as necessary for backups, archives, legal compliance, and previously published materials.
We may remove, edit, refuse, restrict, or moderate User Content at any time, but we are not obligated to monitor everything posted by users.
08Intellectual Property
The Site and its original content, branding, design, code, text, charts, graphics, forecasts, models, and visualizations are owned by ElectIndex or its licensors unless otherwise stated. All rights are reserved.
You may link to our pages and quote short excerpts with clear attribution. You may not copy, republish, redistribute, scrape, sell, sublicense, remove attribution from, frame, or commercially exploit substantial portions of the Site without written permission, except where allowed by law.
Third-party datasets, code libraries, APIs, embeds, maps, fonts, icons, and tools may be subject to separate licenses and terms. You are responsible for complying with those terms.
09Copyright Complaints
If you believe content on the Site infringes your copyright, contact us with enough information to identify the work, the allegedly infringing material, your contact information, a statement of good-faith belief, and a statement under penalty of perjury that the information is accurate and that you are authorized to act. We may remove content and terminate repeat infringers where appropriate.

10Third-Party Services and Links
The Site may include links, embeds, payment processors, analytics services, advertising networks, social platforms, public repositories, APIs, maps, scripts, and other third-party resources. We do not control third-party services and are not responsible for their content, availability, security, accuracy, policies, or practices. Your use of third-party services is at your own risk and may be governed by separate terms.
11Advertising, Affiliate, and Sponsored Content
The Site may display advertising, sponsored placements, affiliate links, or promotional content. Advertising does not necessarily reflect our views. We may receive compensation from ads, subscriptions, donations, sponsorships, or affiliate links. We reserve the right to reject or remove advertising or sponsorships at our discretion.
12Availability and Changes
We may modify, suspend, restrict, or discontinue any part of the Site at any time. We may update, correct, remove, archive, or change content, forecasts, models, data sources, features, pricing, and access rules without notice. We are not liable for downtime, errors, loss of access, or discontinued features.
13Termination
We may suspend, terminate, restrict, or block your access if we believe you violated these Terms, created risk, caused harm, infringed rights, abused the Site, or acted unlawfully. You may stop using the Site at any time. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limits of liability, indemnity, governing law, and dispute provisions.
14Disclaimers
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, security, and error-free performance.
We do not warrant that the Site, data, downloads, scripts, forecasts, accounts, or third-party integrations will be secure, available, accurate, current, or free from harmful components.
15Limitation of Liability
To the fullest extent permitted by law, ElectIndex and its owners, contributors, contractors, partners, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages, or for loss of data, loss of goodwill, business interruption, political or campaign losses, reputational harm, or reliance damages arising from or related to the Site.
To the fullest extent permitted by law, our total liability for any claim relating to the Site will not exceed the greater of the amount you paid us for Site access in the three months before the claim or $100.
Some jurisdictions do not allow certain limitations, so some limits may not apply to you.
16Indemnification
You agree to defend, indemnify, and hold harmless ElectIndex and its owners, contributors, contractors, partners, service providers, and affiliates from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from your use of the Site, User Content, violation of these Terms, violation of law, or infringement of rights.
17Privacy
Your use of the Site is also governed by our Privacy Policy. The Privacy Policy explains how information may be collected, used, disclosed, and protected.
18Governing Law and Venue
These Terms are governed by the laws of the State of Georgia and applicable U.S. federal law, without regard to conflict-of-law rules. Unless a different forum is required by law, you agree that disputes will be brought in the state or federal courts located in Georgia, and you consent to personal jurisdiction there.
19Dispute Resolution; Informal Resolution
Before filing a claim, you agree to contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least 30 days. Nothing prevents either party from seeking urgent injunctive relief or reporting issues to regulators where legally permitted.
20Changes to These Terms
We may update these Terms at any time. The “Last updated” date shows when they were last revised. Continued use of the Site after changes are posted means you accept the updated Terms.
21Miscellaneous
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our consent. We may assign these Terms in connection with a reorganization, transfer, or operation of the Site. These Terms, together with the Privacy Policy and any posted feature-specific terms, are the entire agreement between you and us regarding the Site.
